1. Introduction
Welcome to Webtoza, a Platform as a Service (PaaS) provided by TechFlow Inc ("Company", "we", "our", "us"). By accessing or using the Webtoza platform, web interface, command-line interface, or associated APIs (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms").
If you are accepting these Terms on behalf of a company, organization, or other legal entity, you represent and warrant that you have the authority to bind such entity to these Terms. If you do not agree to these Terms, you may not use our Services.
2. Accounts & Security
To access most features of the Services, you must register for an account. When creating an account, you agree to:
- Provide accurate, current, and complete information during the registration process.
- Maintain the security of your password, SSH keys, and API tokens. You are strictly responsible for all activities that occur under your account, whether authorized by you or not.
- Immediately notify TechFlow Inc of any unauthorized use of your account or any other breach of security.
We reserve the right to disable any account at any time in our sole discretion if we reasonably believe you have violated any provision of these Terms.
3. Acceptable Use Policy
Our infrastructure is designed to host modern web applications. You agree not to misuse the Webtoza platform. Specifically, you must not use the Services to:
- Deploy applications that engage in cryptocurrency mining (e.g., Bitcoin, Ethereum, Monero).
- Host or distribute malware, botnets, phishing sites, or any code designed to disrupt, damage, or gain unauthorized access to any computer system.
- Conduct network scanning, DDoS attacks, or any activity that imposes an unreasonable load on our infrastructure or third-party networks.
- Host material that infringes upon the intellectual property rights of others.
Violation of the Acceptable Use Policy will result in immediate termination of your applications and workspace without refund.
4. Billing & Payments
Webtoza offers both free and paid subscription plans. By selecting a paid plan, you agree to our recurring billing terms.
- Fees: Fees are billed in advance on a monthly or annual cycle. All prices are stated in South African Rand (ZAR) or US Dollars (USD) as applicable, and exclude applicable taxes unless otherwise stated.
- Payment Processors: We process payments securely via our authorized partners, including Paystack and Ozow. We do not store your full credit card details on our servers.
- Resource Limits: If your application exceeds the bandwidth or compute limits of your chosen tier, we may throttle your service or automatically bill you for overages according to the rates published on our Pricing page.
- Refunds: Services are generally non-refundable. If you cancel your subscription, you will retain access to the paid features until the end of your current billing cycle.
5. Infrastructure & Uptime
Webtoza provides automated container orchestration and routing mechanisms. While we strive to maintain 99.99% uptime for our core routing and API layers, we do not guarantee uninterrupted service.
- Application Failures: We are not responsible for downtime caused by errors in your application code, misconfigured Dockerfiles, out-of-memory (OOM) kills triggered by your application, or failures in third-party services you rely upon.
- Maintenance: We reserve the right to perform scheduled maintenance on our underlying VPS infrastructure. We will provide advance notice for significant maintenance windows via the dashboard.
6. Domain Registrations
Through the Domain Store, Webtoza facilitates the registration, transfer, and renewal of top-level domains (e.g., .co.za, .com, .africa).
All domain registrations are governed by the policies of the respective registry (e.g., ZADNA for .za domains, ICANN for .com). By registering a domain through us, you agree to be bound by these third-party registry policies. If you fail to renew your domain before the expiry date, we are not responsible for the loss, deletion, or reassignment of that domain.
7. Intellectual Property
Your Content: You retain all ownership rights to the code, databases, files, and other data you deploy or upload to Webtoza ("User Content"). By deploying User Content, you grant us a limited, worldwide license to execute, copy, cache, and route your applications solely to provide the Services to you.
Our Property: The Webtoza platform, including its dashboard design, CLI code, documentation, logos, and infrastructure orchestration logic, are the exclusive property of TechFlow Inc. You may not reverse engineer, decompile, or copy our platform codebase.
8. Limitation of Liability
To the maximum extent permitted by applicable South African law, in no event shall TechFlow Inc, its directors, employees, or infrastructure partners be liable for any indirect, punitive, incidental, special, or consequential damages, including without limitation damages for loss of profits, goodwill, use, data, or other intangible losses, arising out of or relating to the use of, or inability to use, the Services.
Our total liability for any claims arising under these Terms shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.
9. Termination
You may terminate your account at any time by accessing the "Danger Zone" in your workspace settings and deleting your account. Upon termination, all your deployed applications, containers, and isolated databases will be permanently destroyed. This action cannot be undone.
We may suspend or terminate your access to the Services at any time, with or without cause, including for violations of these Terms or prolonged payment failures.
